A Gênese Constitucional Brasileira analisa a origem Constitucional do Brasil, no contexto da Assembleia Constituinte de 1823 e da Constituição Imperial. Considera que representaram palcos das discussões, diretrizes políticas e das questões jurídicas, atinentes ao Brasil daquela época que, sedento por uma Constituição como Carta de Intenções Políticas, discutia e formulava os ideais do que viria a ser a primeira Carta Magna genuinamente brasileira. Verifica que, em meio ao contexto histórico, houve no Brasil pensamentos e formulações sobre a aplicação de institutos jurídicos, até então consagrados em outros países, com adaptações para as peculiaridades brasileiras, de modo racional, intencional e prospectivo. Utiliza como método a pesquisa bibliográfica e documental, adotando a perspectiva histórica. Demonstra como as práticas históricas que o Brasil vivenciou contribuíram na articulação do Pensamento Constitucional singular, capaz de representar as circunstâncias que moldavam a formulação e a adaptação da Lei Maior, no decorrer do tempo e da História. This book The Genesis of the Brazilian Constitution analyzes Brazil's constitutional background in the context of the 1823 Constituent Assembly and the Imperial Constitution. It considers them as theaters for debates over political and legal questions concerning Brazil at the time, which, thirsting for a Constitution as a Charter of Political Objectives, discussed and formulated the ideals of what would become the first genuinely Brazilian Magna Carta. It verifies that, during this historical moment, there were in Brazil thoughts and formulations about the application of legal doctrines hitherto consecrated in other countries and how to adapt them to the Brazilian case in a rational, intentional and productive way. That author adopts a historical perspective to examine bibliographic and documentary sources.
